where we reasonably believe (in our absolute discretion) that you are in breach of any of these Terms and Conditions or the Privacy Notice.

TK Maxx will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it.

You may purchase certain goods online at tkmaxx.com. Please note we deliver everywhere and anywhere within the UK. However, deliveries to Northern Ireland, Isle of Man or the Highlands and Islands may take a little longer. Unfortunately we do not deliver to the Republic of Ireland, Jersey or Guernsey.

(a) Setting up an Account

In order to purchase products from TK Maxx online you will need to set up an Account. TK Maxx will ask you for some personal information in order to set up your Account. Please see our Privacy Notice to understand how we will handle your personal information.

(b) Placing an order

If you are under the age of 16 please seek permission from a parent or guardian before purchasing online.
By placing an order online you are offering to purchase goods subject to these Terms and Conditions. Please click here to read the Online Purchase Returns Policy, which is incorporated into these Terms and Conditions.

All online orders are subject to availability and confirmation of the order, including order price, by TK Maxx.

When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card or E-voucher used to place your order and that there are sufficient funds to cover the cost of the goods and delivery charges. At this stage you can allow your payment details to be retained for your next purchase.

Once your order is complete you can then follow the status of any orders you make by clicking into “My Account”.

(c) Our contract with you

When you place an order you will receive an acknowledgement email confirming receipt of your order by TK Maxx. This email will only be an acknowledgement and will not constitute acceptance of your order.

A contract between us will not be formed until we or our approved third party courier sends you confirmation by email that the goods you ordered have been despatched to you. Payment will be taken on despatch of the goods.

Only those goods listed in the confirmation email sent at the time of despatch will be included in the contract formed with you. You will be able to access the contract details at any time in your online “My Account”.

The contract will be concluded in English between you and TK Maxx (registered as TJX UK).

(d) Delivery to you

The estimated delivery times will be subject to any delays resulting from postal delays or force majeure (events outside our control, for example due to inclement weather or strikes) for which we will not be responsible. Please see TK Maxx’s Delivery Policy for further information.

(e) Pricing and availability

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. All goods are sold subject to availability and prices of products may change from time to time. If we discover an error in the price of any goods ordered by you, we will inform you of this as soon as possible and give you the option of confirming your order at the correct price or cancelling it. TK Maxx reserve the right to change the price of any item on the Website where that item has been priced incorrectly.

If we are unable to contact you regarding an item that was priced incorrectly we will treat the order as cancelled. If this happens and you have already paid for the goods, you will receive a full refund to the same credit or debit card used to make payment. If you used E-vouchers, your online Account will be credited. Neither of us shall have any further liability to the other. This shall not affect your statutory rights. If you reconfirm the order, please remember no contract will exist with us until you have received the email confirming your goods have been despatched.

All prices are inclusive of VAT. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the total cost. Please see the Delivery Policy for details of delivery charges.

(f) Payment

If paying by credit or debit card, we carry out a standard pre-authorisation check on your payment card upon receiving your order to ensure there are sufficient funds to settle the transaction. Goods will not be despatched until this pre-authorisation check has been completed.

Your payment will be processed once the order has been despatched from our courier. If we are unable to fulfil your order then we shall not process payment.

(g) Right of cancellation for online purchases

If you are a consumer (i.e. you are not purchasing either wholly or in part for your business or you are not a business) you have the right, in addition to your other rights, to cancel the contract and receive a full refund as set out in these Terms and Conditions. The law provides that any organisation selling goods online must allow consumers 7 working days, starting on the day following receipt of the goods, to cancel the contract ("Cancellation Time") and return the goods. If you would like to cancel your contract with TK Maxx please notify us in writing at TK Maxx, Customer Service, c/o TJX UK, 50 Clarendon Road, Watford, Hertfordshire, WD17 1TX or by email customerservice@tjxeurope.com within the Cancellation Time. Please then return your goods by post to the address provided on the despatch note.

If you validly cancel any contract in accordance with these Terms and Conditions we shall refund your payment and delivery charge which you paid when ordering, within 30 days, less any reasonable costs to collect and process the goods, if applicable.

(h) Gift Cards

TK Maxx offer customers two ways of giving gifts: those that can be redeemed in our stores and not online (Gift Cards) and those that can be redeemed online and not in our stores (E-vouchers).

(I) Gift Cards can be used at TK Maxx stores in the UK, Republic of Ireland and in the Isle of Man.

(II) Gift Cards are only valid for a limited time. The Gift Card will expire after 24 months of consecutive non-use and any remaining balances will be deleted. Please note that checking your balance in store will constitute use.

(III) Gift Cards cannot be exchanged for cash.

(IV) TK Maxx cannot accept any responsibility for stolen or deleted Gift Cards.

(V) TK Maxx will despatch your Gift Card either as soon as payment has been cleared or on your specified delivery date (if this is later). TK Maxx cannot be responsible for any delays, no matter how they are caused.

(VI) If you are the purchaser, please double check the delivery email address you enter – it is your responsibility to do so. TK Maxx cannot be held responsible if a Gift Card is used by someone other than your intended recipient if the address you entered is incorrect.

(VII) In addition, we cannot take responsibility for any Gift Cards that are lost or used by someone other than your intended recipient after delivery. Make sure your intended recipient has received their Gift Card. It is their responsibility to keep the card details safe. <

(VIII) We will make any refund payments using the original payment method (such as onto a Gift Card, debit/credit card account, or a combination of the two). Please see our Returns Policy to read more.

(i)E-vouchers


(I) E-vouchers can only be used to shop online only and are currently only available in Sterling. Please remember: if you are ordering from a location outside the UK, we deliver everywhere and anywhere within the UK. However, deliveries to Northern Ireland, the Isle of Man or the Highlands and Islands may take a little longer. TK Maxx do not deliver to the Republic of Ireland, Jersey or Guernsey.)

(II) E-vouchers cannot be exchanged for cash.

(III) TK Maxx will despatch your E-voucher by email as soon as payment has been cleared. TK Maxx cannot be responsible for any delays, no matter how they are caused.

(IV) E-vouchers are valid for 24 months from purchase.

(V) From time to time, E-vouchers may get caught in spam filters, and it’s up to the recipient to check these filters. TK Maxx can’t take responsibility if an E-voucher cannot be delivered to the recipient’s email address because of spam filters, firewalls, capacity constraints of the recipient’s mailbox or any other factors outside of our control.

(j) Colours

TK Maxx have tried to display accurately those products and attributes of the products on the Website, including the colours of products. As the colours you see depend on your computer settings, we cannot guarantee that your monitor's display of any colour will be accurate.


(k) Security

You are responsible for maintaining the confidentiality of your Account details, including passwords. TK Maxx shall not be liable for any loss occurring as a result of failure by you to maintain the security of this information. You may link to the tkmaxx.com home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

The above Terms and Conditions, the Returns Policy and any emails regarding the Services TK Maxx provides constitute the entire agreement of the parties (TK Maxx with the customer) and supersede any and all preceding and contemporaneous agreements between you and TK Maxx. 2. To enter, simply upload a picture of yourself in your Sport Relief t-shirt showing your individual style. People can then vote on the image they like the best. The winner will be image with the most “likes” and will receive the prize of a £250 gift card to spend in TK Maxx in UK.
