Access to this Website is permitted on a temporary basis, and TJX UK reserves the right to withdraw or amend the Services without notice. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of TJX UK’s security procedures, you must treat such information as confidential, and you must not disclose it to any third party. You may only use the Website in accordance with these Terms and Conditions and, in any event, for lawful and proper purposes which include complying with all applicable laws, regulations and codes of practice within the UK or any other jurisdiction from which you are accessing the Website.

In particular, you agree that you will:

Without prejudice to any of our other rights, TJX UK reserves the right at any time to:

suspend the Services offered on the Website;
remove goods from the Website, including any promotions or featured jobs;
cancel your registration and/or online account (“Account”) without prior notice to you;
report any breach under the Computer Misuse Act 1990 to the relevant law enforcement authorities and disclose your identity to them; and/or
deny you access to the Website, where we reasonably believe (in our absolute discretion) that you are in breach of any of these Terms and Conditions or the Privacy Notice.

TJX UK will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it.

Making an Online Purchase

You may purchase certain goods online at tkmaxx.com. Please note we deliver everywhere and anywhere within the UK. However, deliveries to Northern Ireland, Isle of Man or the Highlands and Islands may take a little longer. Unfortunately we do not deliver to the Republic of Ireland, Jersey or Guernsey.

(a) Setting up an Account

In order to purchase products from TK Maxx online you will need to set up an Account. TK Maxx will ask you for some personal information in order to set up your Account. Please see our Privacy Policy to understand how we will handle your personal information.

(b) Placing an order

By placing an order online you are offering to purchase goods subject to these Terms and Conditions. Please click here to read the Online Returns Policy, which is incorporated into these Terms and Conditions.

All online orders are subject to availability and confirmation of the order.

When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card or E-voucher used to place your order and that there are sufficient funds to cover the cost of the goods and delivery charges. At this stage you can allow your payment details to be retained for your next purchase.

Once your order is complete you can then follow the status of any orders you make by clicking into “My Account”.

(c) Our contract with you

When you place an order you will receive an acknowledgement email confirming receipt of your order.. This email will only be an acknowledgement and will not constitute acceptance of your order.

A contract between us will not be formed until we or our approved third party courier sends you confirmation by email that the goods you ordered have been despatched to you. Payment will be taken on despatch of the goods.

Only those goods listed in the confirmation email sent at the time of despatch will be included in the contract formed with you. You will be able to access the contract details at any time in your online “My Account”.

The contract will be concluded in English between you and TJX UK (trading as “TK Maxx” and “HomeSense”.)

(d) Delivery to you

The estimated delivery times will be subject to any delays resulting from postal delays or force majeure (events outside our control, for example due to inclement weather or strikes) for which we will not be responsible. Please see our Delivery Policy for further information.

(e) Pricing and availability

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. All goods are sold subject to availability and prices of products may change from time to time. If we discover an error in the price of any goods ordered by you, we will inform you of this as soon as possible and give you the option of confirming your order at the correct price or cancelling it. TK Maxx reserve the right to change the price of any item on the Website where that item has been priced incorrectly.

If, by mistake, we have under priced an item, we will not be liable to supply that item to you at the stated price, provided that we notify you before we despatch the item to you. In those circumstances, we will notify the correct price to you so you can decide whether or not you wish to order the item at that price. If you decide not to order the item, we will give you a full refund on any amount already paid for that item in accordance with our refund policy.

All prices are inclusive of VAT. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the total cost. Please see the Delivery Policy for details of delivery charges.

(f) Payment

If paying by credit or debit card, we carry out a standard pre-authorisation check on your payment card upon receiving your order to ensure there are sufficient funds to settle the transaction. Goods will not be despatched until this pre-authorisation check has been completed.

Your payment will be processed once the order has been despatched from our courier. If we are unable to fulfil your order then we shall not process payment.

(g) Right of cancellation for online purchases

If you are a consumer (i.e. you are not purchasing either wholly or in part for your business or you are not a business) you have the right, in addition to your other rights, to cancel the contract and receive a full refund as set out in these Terms and Conditions. The law provides that any organisation selling goods online must allow consumers 7 working days, starting on the day following receipt of the goods, to cancel the contract ("Cancellation Time") and return the goods. If you would like to cancel your contract with TK Maxx please notify us in writing at TK Maxx, Customer Service, c/o TJX UK, 50 Clarendon Road, Watford, Hertfordshire, WD17 1TX or by email online_shop@tjxeurope.com within the Cancellation Time. Please then return your goods by post to the address provided on the despatch note.

If you validly cancel any contract in accordance with these Terms and Conditions we shall refund your payment and delivery charge which you paid when ordering, within 30 days, less any reasonable costs to collect and process the goods, if applicable.

(h) Gift Cards

TJX UK offer customers two ways of giving gifts: those that can be redeemed in our stores and not online (Gift Cards) and those that can be redeemed online and not in our stores (E-vouchers).

(I) TK Maxx Gift Cards can be used at TK Maxx stores in the UK, Republic of Ireland and in the Isle of Man. HomeSense Gift Cards can be used at HomeSense stores in the UK, Republic of Ireland and in the Isle of Man.

(II) Gift Cards are only valid for a limited time. The Gift Card will expire after 24 months of consecutive non-use and any remaining balances will be deleted. Please note that checking your balance in store will constitute use.

(III) Gift Cards cannot be exchanged for cash.

(IV) We cannot accept any responsibility for stolen or deleted Gift Cards.

(V) We will despatch your Gift Card either as soon as payment has been cleared or on your specified delivery date (if this is later). We cannot be responsible for any delays, no matter how they are caused.

(VI) If you are the purchaser, please double check the delivery email address you enter – it is your responsibility to do so. We cannot be held responsible if a Gift Card is used by someone other than your intended recipient if the address you entered is incorrect.

(VII) In addition, we cannot take responsibility for any Gift Cards that are lost or used by someone other than your intended recipient after delivery. Make sure your intended recipient has received their Gift Card. It is their responsibility to keep the card details safe.

(VIII) We will make any refund payments using the original payment method (such as onto a Gift Card, debit/credit card account, or a combination of the two). Please see our Returns Policyto read more.

(i)E-vouchers

(I) E-vouchers can only be used to shop online only and are currently only available in GB pounds sterling. Please remember: if you are ordering from a location outside the UK, we deliver everywhere and anywhere within the UK. However, deliveries to Northern Ireland, the Isle of Man or the Highlands and Islands may take a little longer. We do es not deliver to the Republic of Ireland, Jersey or Guernsey.)

(II) E-vouchers cannot be exchanged for cash.

(III) We will despatch your E-voucher by email as soon as payment has been cleared. We cannot be responsible for any delays, no matter how they are caused.

(IV) E-vouchers are valid for 24 months from purchase.

(V) From time to time, E-vouchers may get caught in spam filters, and it’s up to the recipient to check these filters. We can’t take responsibility if an E-voucher cannot be delivered to the recipient’s email address because of spam filters, firewalls, capacity constraints of the recipient’s mailbox or any other factors outside of our control.

(j) Colours

We have tried to display accurately those products and attributes of the products on the Website, including the colours of products. As the colours you see depend on your computer settings, we cannot guarantee that your monitor's display of any colour will be accurate.

(k) Security

You are responsible for maintaining the confidentiality of your Account details, including passwords. We will not be liable for any loss occurring as a result of failure by you to maintain the security of this information. Linking to this Website

You may link to the tkmaxx.com home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

Governing law and jurisdiction

These Terms and Conditions are to be construed in accordance with the laws of England and, in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the English and Welsh courts.

Entire agreement

The above Terms and Conditions, the Returns Policy and any emails regarding the Services TJX UK provides constitute the entire agreement of the parties (TJX UKwith the customer) and supersede any and all preceding and contemporaneous agreements between you and TJX UK. Any waiver of any provision of the Terms and Conditions will be effective only if in writing and signed by a Director of TJX UK.

To enter, post on Facebook via the Fab finds application, a picture of your Daily fab find and tell us what the item is, where it was from and why it is such a fab find.
Entry into the promotion is on the understanding and the acceptance of these terms and conditions. Any breach of these terms and conditions may result in a prize being forfeited
The competition starts at 9am each day (first day being Friday 27th Aug) and closes each day at midnight until Thursday 30th September. The winner will be drawn by 5pm on the following day and told via message on Facebook. The winners will be announced on homesense.com each week. The winner of the grand prize will be the find with the most votes ‘likes’ at midnight Thursday 30th September and will be notified by 5pm on Friday 1st October The winning entries will be posted on our Facebook page. Monthly Promotion Terms and Conditions – Friends of HomeSense

a). To enter, you need to sign up to become a friend of HomeSense and you will be automatically entered into the next available draw.. The Prize Draw is a monthly drawing from all entries made during the preceding month that began accruing the time of the previous draw (on or around the 19th of the previous month). Entries from previous draws shall not be entered into the following month’s draw. One entry per person. By entering the Prize Draw, all entrants are deemed to have understood and accepted and be bound by these Rules. Please retain these Rules for future reference.

b. Eligibility: All entrants must be at least 18 years of age at the time of prize acceptance and must be UK residents.
